In Kessell v Passion for Perfume Limited [2007] ET/1700345/07, a woman whose dismissal was brought about after only two months’ employment because her age and experience were seen as a threat by her younger female manager was awarded over £11,000 in compensation.

Plewes v Adam Pork Produce Ltd [2007] ET/2600842/07 illustrates the importance for employers of obtaining a clear understanding of new legislation well before it is implemented, so as to anticipate any contractual or other changes that may be necessary. In this case because, by terminating its employees’ contracts on the day before their 65th birthday, the employer operated a "normal retirement date" that was below 65. In effect it fell foul of the age discrimination Regulations by one day. Had the employment contract provided for a normal retirement date of 65 or above, the employer could have effected a fair and non-discriminatory dismissal simply by using the correct procedure.

For Clients not benefiting from the HR Director Shared Services scheme, we provide a full compliment of HR Consultancy services ranging from HR compliance audits through to M & A harmonisation or downsizing programmes.   All services are payable  either on a standard day rate or fixed project fee.

For HR Director Shared Service clients, we visit your offices on a regular basis (included in your monthly costs, with dedicated days  according to your employee numbers) to ensure we keep well aligned to your business strategy, and align your people strategy according to both proactive and reactive needs.  You also have the additional flexibility of extra days according to your business needs at a reduction against our standard Consultancy day rates.
